It's certainly not the dealer's fault. Despite a few key members here that feel the need to pontificate about how bad dealerships are at every turn, it isn't as bad as they would like you to believe. Nor is it the dealer's choice to have the rules they do in many cases.
In this case, it is the citizens of KA that are protecting us from ourselves. Votes are what put us in this position. Hell, there are prohibitions against having a fire in your fireplace in Fresno because of the smog. Can't keep warm by burning wood and cost of living precludes many from affording rent, food, AND heat. Still fewer that would want to can even dream of owning a house here.
The dealers' hands, perceived in bureaucracy as an extension of HD corporate, are tied as to what they can do because of KA and federal EPA regs. I'm not sure about the specific legal aspects but Harley has liability if they do the work but Indys have greater latitude.
lmao, I don't know about stuff in California being illegal means that it's illegal everywhere else. I know this doesn't have anything to do with legal issues, but I've seen some random *** stuff "known in the state of California to cause cancer". What, so if I use it in Texas I'm good to go? California must have some kind of wierd atmosphere that makes them more vulnerable to pollution and disease.
As a Cali boy I love the state, i had the same problem when I was looking to upgrade my sporty to 1200, had to go to an independent, sure there are restrictive laws here and a lot of it sucks, that being said we have the best weather, the hottest girls, the best jobs, and were I live you can surf in the morning drive 3 hrs and go sking in the afternoon...oh did I mention that we have some of the best riding roads in the whole country.....oh yeah I ride year round....

The fact that the orignal poster sold his Sporty and bought a BMW notwithstanding, California emissions crap tends to infect other states as well. CARB=California Air Resources Board. A set of standards stricter than USDOT. Texas is a CARB compliant state now. Of course, Texas doesn't ENFORCE it like California does, but if an emissions test becomes an ACTUAL performed part of the annual inspection, that would not go over too well for the Texas biker community. Some other states have joined/ in process of joining/ are going to join the CARB bandwagon also.
