As for the OP: WTF were you thinking? If you bought a Harley Davidson for any other reason than it's a "Harley Davidson" you may not ever be happy with it.
Think about it like this:
Harley Davidson V (45*) twin 1200 cc: Peak HP- 60, Peak TQ-78.92ft lbs @ 4000 RPM.
Ducati L (90*) twin 849 cc: Peak HP- 140, Peak TQ- 72.28ft lbs @ 9750 RPM.
I was going to get the Ducati, and for a very inexplicable reason I chose the H-D. I still plan to get the Ducati in addition to the H-D, but that's at least a year or more off. You had to know what you were getting into didn't you?
If a Rider started out with OHV scoots or just decided to just get on for the raw loud power and the total kick in the pants the Sportster will deliver that. The machine is also way out dated in most ways. Deal With It.
I got on an older (2001) BMW r 1200 c in new mexico over the weekend...ghessss what a Motorcycle !!! 23,000 miles $7,890 Not the same at all and I would still keep my Sporty as well but I am looking for some bucks.
All together with all it takes to keep her running I would never bitch about some damm thing rubbing.

H-D did get IT right, you just aren't taking into consideration what IT is. The vast majority of H-D owners care about looks, sound, and feel. By feel, I don't mean performance, I mean feel. The motor company plays to that market, it isn't going to change. They developed a better engineered scoot and everyone balked at it, so they keep focusing on "bringing back the classics". You don't have to stop whining, but it may feel better for you if you lower your expectations a notch or two. You brought up the comparison to your Yam, so I'm not just bashing you man, just telling it like I see it.
Many solutions to the fender contact issue, my favorite being upgrade the springs/oil in the tubes. 2 for 1 right there.
Rocker box gaskets apparently leak, and need semi frequent replacing. I haven't had to do mine yet due to leakage, and I will deal with that when the day comes. I will try to find something that works, but if I have to replace them every 5-8k I'm ok with it.
