Considering these are for "TOURING" bikes, if the silent inserts aren't intended/designed for extended runs then they should definitely note that in the product description... which, IMO is a bit vague as is per their website. I think the OP has a legitimate gripe, and is not out of line by wanting a refund. JMO

i guess i didn't articulate well enough..... i was looking for something a little more specific than 'kinda sorta more than but less than', especially something as vague as 'our regular jackpot baffles. i've never heard their regular jackpot baffles. how can i make a judgement based on an arbitrary value that holds no meaning for me? ..... maybe a honest db rating comparison might help?
what I haven't seen mentioned is how quiet is it before you put in the insert?

Sounds to me that there is a huge misunderstanding here. FM replaced the defective baffle and has clearly stated that the recommendation that it is not for long term use is NOT due to the workmanship or longevity of the baffle but due to its restrictive properties. You can shove a potato in your tailpipe and it might quiet it down but I wouldn't want to run all day with it .

I specifically asked before I purchased the baffle if I would need to adjust my PC5 to adjust for the restrictive nature of this baffle. I was told no, it is not necessary. Hmmm....
I'll let you guys figure this one out! Not quite like a potato in the pipe!!!
Thanks for your factual post, a company that stands behind their products would have issued a refund, more so because they know the LIMITATIONS of the device and they do not make you aware of it when purchasing.
I would be interested to see you bring up the matter to someone higher in the company, seems any reasonable company would issue a refund and updated their site
