The baker shifter really only corrects the upshifting issue.. Here is a picture of the shift arm in a tranny with the arm positioned at the end of an upshift. You can see the nub blocks the end of a pin in the drum to keep it from rotating further. The picture shows a Baker shift drum also.. I had chronic over shift when going from second to third. Tried the drum first as it was easy to replace and it shifted better but still over shifted. It's funny but this bike first started doing this when I changed over to synthetic tranny oil.
If you are having issue on the down shift also, its more likely that the shift detent spring is weak.
As bwotlz described our pawl is designed to make sure the trans does not overshift on the upshift.
What you are describing may actually be an under shift. As in when you first shift you may be making a "half shift" then when you shift a second time you go past the intended gear and into the next.
Check your linkage first. Make sure everything is tight and the long shift rod is parallel to the rest of the bike and not binding.
Harley shift levers are cast and the splines wear out quickly so double check that it is tight on the shifter pawl shaft.
If the problem seems to happen in a certain gear all the time it may also be a bent shift fork or fork rod.
I had same issue , mine being worse where it would land between neatral and second also. So I rebuilt the trans with a Baker master rebuild kit. The best things in the kit are the shift paw & shift drum. It solved the false neutral between 2nd &3rd except one time last summer when I was ragging on the bike I missed 3rd and it revved way high on my 25 mph speed zone street so it sound real bad for all my neighbor's. That time a probly didn't have a firm foot on the shift like I tried to train myself after the rebuild. But after riding metrics it's hard to change the guick flick mentalety. Keep in mind this is after 14000 miles of trouble free shifting & ease of finding neatral 10 times better. Recommend the paw for sure much better design but alot of work to change.

I thought that if say going from 2nd to 3rd and you ended up past third gear that was an over shift (3 1/2 shift). If when going from 2nd to 3rd and you end up between 2nd and 3rd (2 1/2 shift), it was undershift or halfshift..

I run a baker shift drum and shift arm in an 2000 FXDX and it shifts like a sport bike except for first gear. First grinds a little going in while rolling and too light a tap. I attribute that to the Andrews close ratio first tho.. They didn't cut the dogs right.
