Yeah we've got that rubbish on our bikes here in Oz. We usually either get it turned off so the valve stays open or replace the headers and get rid of that and the cat such as i did.
Active exhausts are not limited to sound and emission requirements. They have been used over the years for increased performance also.
Buell had an active exhaust that routed the exhaust through three passages. One for low speeds, one for mid range and then high speeds. It is one of the reasons that the Buell XB12XT was rated at the crank for 103 HP and the identical engine except lacking the Buell intake and exhaust on the XR1200 was 90 HP at the crank.

True, many manufacturers use the valve to help low end torque, for noise and epa requirements. They seem to name them differently also: Yamaha (exup) Honda (HTEV) etc...
I just call them flapper valves.
Was the active exhaust a factory option on the '70 GTO or an aftermarket item?
MY '07 Vette Z06 came stock w one. Chevy estimates when it is open (around 4k RPM, I think) it adds about 5 hp. I hocked up an aftermarket switch so I can open it up at any RPM. But it is annoying if left open a long time.
