Not sure what's going on, rolling the throttle forward while stopped is the way to toggle EITMS on or off, I think the stranger issue is that you have to roll the throttle forward to enable cruise control (never heard of that before). Does the cruise control button on your left hand controls not work?
Noooo. The cruise control light is the one that flashes when you go to enable/disable the EITMS. To turn on cruise control I flick switch on dash and use the controls by throttle (which is on my right side).

Oh, I misunderstood/read your post. I think back then EITMS was enabled by default and you had to turn it off every time you started your bike. I believe the dealer can disable EITMS, but you can't

Correct , my bike is the same way , it's always on unless you disable it every time you start your bike . The dealership can reprogram it so it stays off , and you turn it on manually , pretty much the reverse of what it is now .
I'll add that I've never understood why people are so freaked out about EITMS, but everyone's different I guess
Not as much "freaked out," but when I changed the fluids on my rebuild I used Lukas Primary fluid instead of the HD Formula +. After I rode for a while I would hear "noises" coming from the primary are. I wasn't sure what to do so I decided to swap the Lukas back to the Formula +. Still had the issue when bike was hot and I came to an idle. Dealership that did the rebuild was like 2 weeks behind. I was ready to remove the primary cover, but that's costly ($35 gasket, $18 fluid), so I researched and researched and researched (mostly on this site) and came across the whole EITMS debate. Long story short, when it's off I don't get that sound, when it's on, I do. It's just before I finalize that that was indeed what I was hearing, I need to be sure about the enabling/disabling.
Summer is almost here and I will enable to see what it's all about.

That's because at one point the dealer set it that way. I don't think that's the default from the factory on that year.
they started eitms with the 2007 bikes. the dealer had to enable/disable it using digital tech. default was disabled, they would enable and if you didn't like it, disable it, one time, under warranty. mid 2008, they changed to where the operator could enable/disable with the throttle. been that way since.
now, you say 'before you ride', does that mean that you are doing this after you've started the engine? if the bike is running, it will not 'remember' your setting, you have to have the bike off when you do it.
