update to interesting phone call
this defendant and I talked on phone again today.
We reconfirmed the settlement offer and their attorney is drawing
up the release of liability papers.
This defendant says they tried to talk the other defendants in joining in
with an out of court settlement and put it to rest.
Both refused.
HDMOCO with all their money, would rather try to run roughshod over me with all
their power. doesn't make sense over such a small settlement sum, and to fix
items that should have been fixed correctly under warranty.
Moco is using the term "atmosheric conditions" as an all encompassing escape clause.
But I feel if an item does not survive the two year basic warranty condition then it falls
under another clause.
Guess we will see what happens come the court date.
