Noticed today that the toe shifter is loose with a bit of slop , but the bolt is good and tight .. All these years and this is a first , thinking probly gonna hafta replace the spline shaft ..
I had the same thing happen on my 07, including having the heel shifter fall off twice. The shaft and the heel lever were replaced under warranty at around 14 months. No problems since.
I am guessing here. I would think the cross shaft would be a more tempered metal (harder) that the shift leaver. You may just need to replace the toe shifter arm.

I think you're right. The shifter is chromed aluminum if I'm not mistaken, the shifter splined shaft is a hardened steel. The shifter on my '04 Dyna has a steel insert in the shifter where the splined shaft goes through so the shifter doesn't clamp directly around the shaft.
Try replacing the heel shifter. The toe and heel are the same part #, 33895-82C and about $35.00 at discount. Or just reverse the two and see if the other shifter grips better, if it does, the slipping shifter is begining to strip.
I had the same problem immediately after driving off the lot. The peg flew off. Drove back to the dealer and it was replaced. No problems since. I would guess the peg was not bolted correctly and probably cross threaded. I have not had any problems with the shifter arms or linkage.
