The exact same thing happened to me except it knocked my right bag right off the bike. A younger guy, his gf, and an old lady all in the car. The car looked like the guy would just hit anything that was in his way. These three get out of the car yelling how I cut them off and hit them! The Leo that showed up could of cared less Said it was their word against mine. Pretty much said no harm no foul. I got totally pissed then it was like he really didn't care. He actually threatened to toss my *** in the pokey for all the cussin that I was doing after that. I figured what the hell it was going to cost me a bundle as it was they might as well get an ear full for all the good it did.
Glad to hear it worked out for you. I worked the collision center for the local dealership most of last year (since moved back to the main store) and you wouldn't believe some of the bad insurance company stories out there. I pretty much just wrenched on the repairs and didn't deal with the ins co reps all that much. Even then it was easy to tell the competent ones (Progressive and State Farm come to mind) and the worthless ones (pretty much the rest of 'em). Almost as amusing as watching some insurance guy try to figure out where the gear shift was, were some of the stories a few of the riders would make up to cover up stupid mistakes.
Just an update to this thread. Whoo Hooo, Progressive took it to arbitration and won. So they get their payout back and I recover my $1,000 deductible. I am very impressed with Progressive and the claims rep assighned to my claim. Now I have an extra $1,000 to pay for some spring mods. All in all a good learning experience, but it feels good that the truth prevailed.

I had kind of the same thing happen to me but i was in my truck and not on my bike. The cop said there are no witnesses and its their word against mine. I filed a claim with the insurance company and told my agent that I don't care what they said it was there fault cuz they pulled up from behind me and I had my blinker on. I ended up paying my deductible and getting my truck fixed. About a year later I get a check in the mail from my insurance company for my deductible. They fought the other insurance company and won. I was totally shocked but it just goes to show its always better to be honest. The punk in the van that sideswiped me was lying out his *** and he ended up paying in the end.
don't eat it. go to court over it. allow her to expose herself as a fraud. i'm surprised that the cop was not more attentive to doing his job thoroughly. good luck man, that sure would suck for that to happen. hope you get it resolved to your satisfaction.

Are they replacing your frame? That tab being cracked/torn DICTATES frame replacement by Harley but ins companies try to get out of it all the time.
How did she get so much space between you and the right hand curb? Where YOU should have been. Were you initially thinking of turning left?
No offense, but I wonder the same thing. I'll be in the "Right hand tire track" when I want to turn right, At the very least the "OIL TRACK" if I want to be taking up as much of MY LANE as possible..

Thanks for the comments. There was no left turn at this intersection, it was a T. I was in the right tire track and was shocked that someone got around me on the right. This is in the city and there is a row for parking cars on the right side of the street. There were no cars parked near the itersection so I guess she drove into the parking lane and then shot past me in the intersection. She was not parked and did not pull out from a parking space. I had my blinker on and checked my mirror. I guess I will try to be more careful about looking over my shoulder before turning right.
Progressive rep was an experienced motorcycle rep. They paid for a frame replacement, no questions asked and the dealer had a check from Progressive in a couple of days. She also inspected the bike and noted the damage which confirmed my story, and I am sure was important in the arbitration hearing.
