Good Day,

As of May 28, 2010, we have been asked by “Julian” Service Manager for San Jose Harley
NOT to bring our 2009 FLHTCU back to our Purchasing Dealer for any type of service.

Our family has been a loyal customer to San Jose Harley since 2007, when they first started to work on our first Harley 2007 FLHX and have had no issues with the dealer until 5/28/2010.

If we should accept “Julian” request that we never bring in our 2009 FLHTCU, this would cause an additional drive miles of 20 to 45 total round trip miles to our 2 other Harley dealerships.

Given the History of this bike and the fact that all work has been done by San Jose Harley:

Replacement of: (time spent in service at San Jose Harley of more than 29 days)

Frame – due to missed weld at factory
Swing Arm
Gas Tank
Rear Shocks

We are having a hard time understanding why “Julian” is requesting NOT to bring our 2009 FLHTCU back to our Purchasing Dealer for any type of service.

Can you please explain in writing and Fax your response to

Maybe corporate made them responsible for the "damage' and do not want to take care of it??

Did you ask "Julian" to put that request in writing? Damn - you must have pissed them off big time. I remember following your original thread. I assume the bike is in perfect shape at this point and that the dealer just hates your guts. On the other hand if the dealer thinks you have a lemon and doesn't want the hassle of negotiating with Corporate . . .

As a private company, the dealer can refuse service to anyone he/she chooses.

As an individual, I would not spend my money where it's not welcome. But that's just me.

If there are legitimate warranty issues, I would think that the Harley Davidson dealer would be obligated not only to you but the service agreement that a dealer makes with the Motor Company when the doors are open. I would contact Harley Davidson directly at this point.

Legally I'm sure you are right. As a Harley Davidson franchisee I would expect they would be required by the Company to perform at a certain level to maintain their contract. In certain circumstances the MoCo can and have closed dealerships down. Not just for financial reasons either. Not suggesting this would be one of them but clearly the MoCo has sway.
