It's a fact a helmet can save your life. But there are some accidents that no amount of protection will save you. 75 mph into the side of a car is going to be unsurvivable no matter what you do. We all know the risks of riding. Do what you want.
Not true, a couple of weeks ago my buddy in Bakersfield paid a 180.00 ticket for a no dot helmet. I know , Bakersfield is the armpit of Ca. but its still Ca.
Did he fight it? Or sheepishly pay the fine. A judge in Santa Clara County declared the law unenforceable and unconstitutional as written. Plenty of information available to fight it.
are you really asking this question??? I guess for the same reason i wear a non dot in florida. It's about choice. I wear a non dot novelty helmet because it's light, cool, and it keep the sun from burning my hairless scalp. My wife's wears a dot because that's her preference and i don't ask why. That's her choice, she respects my choice, i respect hers.

I certainly dont want to get into another argument about helmet law.
But what in the cali law makes it unenforceable, just curious?

Do you really think we need our court system tied up on some stupid $hit like someone's interpretation of the helmet law. I have read the law and it seems pretty cut and dry to me. They allow Californians to ride their motorcycles between cars and yet they are splitting hairs on a helmet law. Completely ridiculous.
I wear a DOT helmet because I want and prefer to. I also live in a DOT state so I am supposed to. When I travel to non-DOT states I enjoy riding without a helmet. Sort of a 'when in Rome, do as the Romans do' approach to helmet law. I understand the need for a good helmet but also enjoy the freedom of riding without one.

It leaves it up to the officer in the field, who has no specialized training, to determine whether the helmet meets the criteria of the DOT standards. The language is also too vague to be enforceable. You can read the whole story here http://boltusa.org/docs/richardquigleyvcalifornia.pdf

You could say that about many laws. As far as cut and dry. the ninth Circuit Court of Appeals disagrees with you. Read it here http://boltusa.org/docs/richardquigleyvcalifornia.pdf They think it's unconstitutional. Don't you think that's worth fighting for? Or do you choose to give up your constitutional rights for the sake of not wasting the Courts time "on some stupid $hit like someone's interpretation of the helmet law".
Quigley felt strongly about it, and took them to task on it.
All this helmet thing in Cali is a couple of jerk off's trying to make a name for themselves. They know what the law means. They have just decided to make it an issue. Lots of laws open for interpretation, but at some point, you have to use some common sense. Something these clowns are lacking.
