You're right.

While not getting into the helmet law again, I read your .pdf file, and to me, it is extremely vague, yes, but so are most laws, as well as many of our constitutional rights.

"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

While I agree that it is my right to keep and bear a gun, this has come under fire in so many ways from sunday, I see a lot of arguments that we no longer maintain a "well regulated militia" therefore the ammendment is moot.

Point? Everything can be interpretted, and that law should, to the layman, simply mean wear a helmet.

The Plaintiff here has abused a loophole, that you can find in most laws, he found a liberal enough judge to go along with his thoughts.

Carry on.

I thought to be legal it had to be DOT approved to prevent a ticket?
Also, isn't it kinda like carrying a gun and not loading it.....useless????

Has absolutely nothing to do with constitutional rights either.

My NXT Helmet is NICE and small. Fits in a saddlebag and is even DOT approved. I like not having a mushroom head with my NXT but trust me, the years of working on a fire department on a ambulance if you are going to wear a helmet wear a good one! I'm sure you can imagine the stories I could share.

Ride safe...

I live in a helmet required state (GA), and wear my non-DOT because i like it. In the winter, I'll put on the flip-up DOT helmet for the warmth. When I pass through states that have no-helmet laws, I still wear the non-DOT. My choice.......I own 4 other helmets that are DOT approved...just haven't found one that is not WAY too hot in the summer.

I live in a state (Delaware) where helmets are not required. I dont have to wear one but, I choose to. I used to wear a novelty helmet because it offered some protection. I mean, a hard hat on a constuction site offers protection right? Most novelty helmets I have seen are much stronger than a construction helmet. I thought if I am going to wear one, I might as well wear a DOT. I have the smallest one I could find. But, I totally respect those who choose not to wear one. I also choose not to smoke but, I think those who want to have every right to do so. We live in America and should be able to choose.

Why do the DOT riders seem to be so militant, or is it jealousy, against the novelty riders. This is supposed to be a free country where free people are free to take risks and responsible (insurance) for themselves when those risks go awry? Why not you make your choice, I won't complain; and let me make my choice without you complaining.
