...if it were me I would work with the adjuster and tell them you are going to fix it yourself or sell it as-is. Take the money and get what you want. Heck you may even come out better...I've done this before and made out like a bandit.

Hey, Im just south of you Rock, this was on FM 487, outside of Florence, TX. It was a TXDOT job, I documented the scene with lots of photos and even had the County Sheriffs come out and do an accident report, he documented the road condition and the fact there were no warning signs. What pisses me off most is the fact they left loose material in the middle of the freeg'n curve and it's coming out of a second curve so your blind to it until too late. Budget cuts for roads cost me dearly. This road is off my routes now, even though it's a direct route to the house from my job on Ft Hood. Pretty sad when taking the Interstate is safer than State maintained roads.
Sorry to hear that. I've had many "close calls" with that crap. I would definitely have a chat with a lawyer and see if you have a chance. You never know.

Like everyone else here, I would definitely see a lawyer....I'm not one to be sue happy, but negligence like that could have cost you your life! Yeah, Definitely see an attorney cuz the road condition is unacceptable and extremely dangerous. Glad you're OK and bike can be repaired.

I dropped an FLHRC about about a year and a half ago. North Carolina law is, if the vehicle has suffered damage of greater than 1/2 its value, it MUST be totaled. Progressive told me that their policy was 1/3 the value. In any event, my damages were $6.5K and took the cash + the wreck and got a FLHRCU.
It wouldn't hurt to chat with a lawyer. I would personally, never sign ANYTHING from an insurance company without a 30 minute chat with counsel. Just me.
It really pisses me off when DOT workers figure that if it's good enough for a car, then they're done. I was up in MA on business last week. Getting on an onramp, I noticed a sign "Motorcycles use caution" as the onramp was particularly rough and buckling. Not that they are gonna fix it, but still.....
