Yes the copper washer needs to be used. You cannot use a hex head if the round head sits below the surface of the fork leg and the hex head won't sit below the surface. I highly doubt it is 5/16" , I would bet it's metric .

I just bought the chrome drain screw kit from my dealer. Two button head cap screws (chromed) and copper washers. Something like $6.99. Not a bad deal.

It is a metric thread, but I can't remember the size off hand. The copper washer is a crush washer specifically designed to be used under the head of a cap screw to create a seal. Eliminating this type screw and copper washer for a flush set screw is counter productive. Your forks won't be sealed. If the MoCo wanted a flush type set screw they would have used a tapered plug. Why ***** with it?

mrfuji, do folks in Quebec deliberately not learn English as a form of protest or in support of Qubec separtism?

The copper washers are HD pn#45692-99 and the thread size of the screw is 8mm x 1.25
