scratched front fender...need help

Default scratched front fender...need help

Okay I have a question and would like some opinions...I have a 2012 Ultra Classic that I bought in the beginning of March. As of today I have 9700 miles on it and this morning before going on a ride I cleaned the bike, and I found a gouge in the front fender on the side just behind the fork. I was able to determine that when using the front brake the bike "dives" and the brake fluid line caught the fender and sratched the paint down to the metal.
My question: how hard should I push the dealer to make it right?
Also what is "Right"

You just have to make your case that it's a warranty issue. If they agree, they, in turn, will need to talk with Harley to see if Harley will cover it. I think you have a shot. Is there any way it could be argued that the brake line has been repositioned by you or the dealer? The other possibility is that the dealer takes care of you under their good will budget.

I can't imagine a rubber coated brake line gouging a fender to the metal. Are you positive it was the brake line that did it and not road debri?

armstronges, yes I am positive it's really not the rubber line, it is where the rubber line goes into the metal fitting

No it isn't the banjo fitting, it is from where the rubber line is connected to the metal line just below the triple tree. I am going to include two pics one is the scratch and the other is the rubber/metal brake line, the one with the line looks as if there is a scratch on the fender but there isn't that is just dirt from the ride today. The gouge is a little over 1/2 inch long and about 1/16th of an inch wide and is down to metal, it is on the right side when sitting on the bike.
