That's what makes me laugh about this state. Some yoke can drive down the road in his Dodge Cummins diesel with no muffler at all and it is ok but a muffler on a bike is now a crime.

Actually..... any diesel newer than 2008 needs a muffler and a DPF (diesel particulate filter).... and they check that at the bi-annual smog check for diesel trucks.

I was thinking of removing the DPF on my '08 Dodge 1-ton diesel. It would increase gas mileage tremendously.... but the smog checks made it a pain in the a$$ so I left it stock.....

Everyone (car- truck -bike) is getting hammered these days.......

If you have stock pipes, go out and try to find the epa stamp on the pipes....
Yeah, I forgot to mention that part. Manufacture date 1/2013. Also, any peace officer can give you the ticket. The law says its illegal to "park" the bike with the wrong equipment. I can see this as a revenue generator for cities and counties. Meter maids, etc. Not hard to find the EPA etching. Right on the outside of the pipe.

Newer bikes already have smog equipment and it is against federal law to remove it...I really can't believe they haven't cracked down on that ..but the day is coming..that is why I only own antique bikes...

I can totally see this law being used to generate revenue. Cities are all hurting for money and will do whatever they can. In my Bay area city they have stepped up Photo ticketing, stricter parking enforcement, ticket quotas, etc

They have been talking about this law here in CA for years. One of many reasons I rebuilt my bike as opposed to trading for a newer model.

There are already several aftermarket approved slip-on's with proper marking.

Like most of us, I enjoy a healthy sounding bike, but also know that if I ride in a manner to attract attention, I also stand a good chance of attracting the attention of the police.

In San Diego, most police leave the average Joe Harley rider alone. If you are riding in control, not annoying others, and generally going about your business, they have no reason to pull you over.

Same with sport bikes. If you are riding down the road, no problem. If you are riding at 10/10th on the curvy roads, with your bike layed over, and crossing into oncoming lanes, they will light you up.

For the most part, riding solo, in groups, or attending ralleys will not result in being hassled by the police.

If you are sporting 1% colors, blipping throttles for no reason, showing off, speeding, driving aggressively, annoying others or other anti-social behavior, you will draw their attention. (thinking I have been guilty of most these : >)

Motorcycles sold in the US have had to meet EPA emission standards since 1978.

It's already a violation of CA VC 27156 to remove smog equipment from a street bike. LE has neither the training nor the desire to enforce it. There is a program (dubbed Fast and Furious) that has LE being trained to identify and cite illegal modifications and also to identify approved modifications on Ricky Street Racer cars. The idea is to get racers off the street, not really to lower emissions.

The reason why it is not enforced is because all states (including CA) submit plans to the EPA on how they're going to reduce pollution in their non - attainment areas. The EPA will either approve of the state's plan (SIP) or not. Most states (including California) have their plans approved without smog testing bikes.

California did not start testing diesels until 2010. Our SIP only included 1998 and newer diesels up to 14,000 lbs GVW and EPA approved it. There is no tail pipe emission test but there is a snap throttle test.

With California going to an OBDII only test on 2000 and newer vehicles in 2014, it is unlikely that motorcycles will be put back on the table as tailpipe testing will become obsolete and identifying tampers on motorcycles is too cost prohibitive as the procedure would usually require dis-assembly.
