Well the only way to tell if a helmet fits properly is to cinch down on the chinstrap.
So beings that you didn't do this plus the fact that according to you that this isn't an issue with just this one particular helmet when fitting on your head. And if there is an issue with this model of helmet then you should identify the model so others may be aware of this possible issue.
I think you blew it and it's on you as you may have unique fit issues and should have know this or at the very least checked the fit of the helmet with the chinstrap cinched.
Also in light of the lack of specific information in this post I think a photo of your noggin frontal and profile should be in order.

There was another model, and I didn't get the model number...was told by the dealer that it was a "limited edition" that is similar other than paint scheme. When I tried it on and showed them the problem...they were concerned enough that they pulled it off the display. I am packing the one I have up and sending to HD and see what their response is.
Unique fit issues? Really??? Odd considering I have been riding since 1970 and have never had this issue before....with HD, Shoei, Shark, Bell, and other helmets I have owned over the years. Freely admit I should have done the chin strap thing...and admitted so in the original post...which you might have not read close enough. It won't be a mistake I make again.
Put a quick release on it, and be done with it. If it fits well and you like it you can also take it to a leather shop that does stitching and have them at more to the short strap and you wont even be able to tell.

I had a problem with the Incinerator I bought for a cross country trip and called the dealer and they couldn't do anything but I called Harley and they put me in touch with the manufacturer and they worked with me to clear up the problem. My problem was with the liner though.

I know they don't usually do returns,but if you showed them your problem,one would think they could make an exception. Then again,this IS a Harley shop
If this is the same helmet they have been carrying for 3 or so years, with the visor that goes up into the shell, they were made by HJC. I found that out and bought one from them. I think it was about $80, without the fancy HD paint and decals of course. If your dealer is no help, you could go back to HJC for a manufacturing defect. Harley should take care of you, but they seem to just want money and to he!! with customers.
I got lucky I bought a Helmet in 09' when I picked up my new RK because I didn't own one (never lived in a state I needed one) rode home ordered one online and returned it the next day for store credit...
