Bingo!!! Now maybe his friend (the driver) will convince him to keep his actions to himself, and be ready to take responsibilty for his own actions....i.e.. ain't gonna ride with me anymore!!!
I doubt that the full extent of the law resulted in much more than a ticket he already deserved. AND if LEO was doing his job "by the book", he souldn't necessarily have considered "letting him off" to begin with...(just wondern' why was the driver in the back seat of his car to begin with?? Whenever I was stopped for minor taffic violation I was told to stay in my car??)
I can see that I must be getting too old to relate to these issues. Let 'em do whatever they want to, just hope it doesn't result in any adverse action to anyone I love or care for...
And we don't even know if this guy was a friend... now do we? ... The only thing we do know, is that he was sitting in the back seat ... fingering off (so to speak). We have no way of know to what extent they were friends.

And no one is arguing the driver broke the law, Yes he did, and he gotcaught doing it, and was going to be given a warning citation....BUT THAT IS NOT THE ARGUEMENT HERE! The issue is more about the transition from the minor citation to the full blown charges due to the actions of someone unrelated to the 'crime' itself.
My view is that flipping the bird to a "representative" of the law is sorta like flippin' the finger TO the law; the LEOjust beingthe symbol and enforcer of it. Just like flipplin' the finger to the flag of a country (ours or anyone else's) is flippn' the finger to the country.
Somebody should try to instill common couresty of others and general respect of the society in which they live. If not by parents, teachers, law officers, courts, well maybe friends even maybe.
Didn't mean to stir sh*t, just new to board and found this interesting thread with so many points of views, figger'ed I throw in.... now I'm out. It is done and "it is what it is".

After reading all the high and mighty comments I do believe that I will write all HD riders only CITATIONS and no more warnings. Now let’s see how this comment goes over. Now be sure to give me the finger as you pull off, as I will be the one standing there with a smile on my face saying “have a nice day!”

One thing that seems to have been missed here (regarding the 20 yr old and the finger deal) is the LEO should be thanked for reminding folks that responsiblity and respect are traits that should be a foundation of our society. Unfortunetly it seems the more "tolerent" authority figures are of bad behavior (LEO's, teachers, bosses, etc.) the message seems to be that it's ok to be an a$$hole (accepted behavior). I'd be willing to bet the guy who was proud of his IQ by expressing it to a law officer has never been properly taughtabout being responsible for your actions (getting your bud a ticket because of him), or is the type that constantly pushes the envelope (speeding, underage drinking, etc). Too leinient of a up-bringing.
The driver did something illegal to get stopped in the first place, and a ticket was warranted, period. The fact that Nightrider was going to give the kid a break, (which totally pi$$es me off...if he deserved it, give it..no Mr. Nice Guy please), and his pal decided to show is butt, well hopefully the driver did get some sore knuckles when they got home.
I have had my run-in's with LEO's but when I finally got my head outta my a$$ and realized the reasons I was "hasseled" was because I was doing something wrong in the first place. Ever since I've grown-up, I simply decided to not push the envelope (actually do try to obey the law)and haven't been in any situation of concern. Have I gotten tickets for speeding... ahhh, ya, but guess what... I was speeding. Why would I expect a LEO to stop me and give me a warning?!!??
What I have a problem with is that the cop didn't "teach" the kid in the back seat anything "about being resposible for your actions". He chose to take his anger out on the kid that was in his cruiser, while the idiot that gave him the finger got off scott-free. That's where your argument "teaching resposibility" falls apart. More likely all he taught that day was that cops are jerks, and likely lost any respect the driver may have had for them.
In the army, I had to salute superior officers, even thought I thought a few were flaming idiots. But then I rememebered, I was saluting the rank he/she held, not the individual. I guess this other situation is kinda like that. I guess you're showing respect for the law, you're not honoring the cop. But to disrespect the cop is a slap in the face of what he stands for and all those that have paid some much (sometimes with their life) for enforcing it.
I have been stopped several times over the years and I think because of the way I reponded to the cop, only got warnings. Surely, I had done something wrong to warrant the stop - and I appreciate the break he gave me. BUT, I have never been DUI, ever. I don't think a DUI should get a warning - its too dangerous to be DUI.
