In Wisconsin we do not have the public intoxicant law so if I had stopped someone for DUI and the passengers are just as sh*t faced as the driver I always did what I could to get them home. Whether it was calling a cab, calling their family or making some kind of arrangement for them. The last thing I needed was some drunk trying to walk home and gettin his *** run over while he staggers into the street, or freezin to death cause they passed out on the side of the road. In our state we have to control the situation and the passengers are part of that. In my 25+ years as a Deputy I never allowed a drunken passenger to just wonder off so I could take the driver to jail. Guess I couldn't live with myself if I did and they got hurt, raped (in the case of a drunken female) or killed by some means...but thats just me.
Now this makes sense. Thanks for saying this, Lil Truckr. I never saw the sense in jacking someone up for another person's actions, just because you can. I locked up several passengers, but always for something THEY did. I understand the frustration of someone thumbing their nose at your authority, but you shouldn't punish someone else for another's actions. I had an old Lieutenant that told me that everyone has done something which can warrant going to jail, sometimes you just have to look a little harder to find it.

I consider myself a pretty law abiding citizen. I pay my taxes, I am courteous to other people, I abide by the law and I don't drink much as a rule. But, on occasion...yep, yoooo bet...I can tip a few. I live in a small town, and although hubby and I don't make a habit of it, we occasionally walk home for our local tavern...because we are slightly over the limit to drive....(if we are waaay over the limit ... we would opt to get a cab ... mostly because the limits of my bladder... but that is a whole serious ofother offencesI don't want to get into right now and after our bars close, there is often at least an hours wait for a cab... I live less than 20 minutes walk)Yes, we may be over the limit of what is considered intoxicated when it comes to driving ... but is there are limit for walking safely to a short destination?

Personally, I don't see the danger of walking home, slightly influenced. I would be mortified if I were arrested for something so unnecessary.

Wow this is going to get into a great pissing contest!

First KNOW WHO YOU ARE RIDDING WITH… if they have warrants, if they have been drinking etc… my friends I choose to hang around with would no pop off at the mouth to cause problems.. I say choose your friends. And if that’s who you like to run with that’s your choice.

And we are not baby sitters. If you are drunk and the person you are ridding with goes to jail for a warrant then like I said, we give you a chance to get a ride home.. if you cant get one, I am not paying your cab fee, and your not riding in my car as I am heading to jail and now you’re my responsibility again. Your not walking away drunk!!! I am going one way and if that driver is DUI then I am on a dead line. So when it is time for me to leave and you’re not gone then we all go together.

So why blame me, your and adult making adult decisions and you choose to climb in with that good ol friend that has warrants. OH and don’t call someone to come pick you up if that person is DRUNK… they did that this weekend and the first driver went to jail and now you’re the passenger and your buddy picking you up shows up intoxicated and now he is gone. Then your making another phone call.

It not always the driver that gets the driver in trouble! Yes lippy passengers will get the driver in trouble if I can’t tag the passenger for anything…..

Had a car load of 20 something’s, the driver sitting in my car as I was half way through a warning citation when I noticed one sitting in back seat giving me the finger….had a little talk with him and returned to my car and tore the warning up and had the driver sign 3 citations that he was getting the warning for. He was a little confused and I just pointed to his buddy still flipping me of and said be sure to let your buddy know he is the one that cost you the $$$ in place of the warning you would of gotten because of his actions…. This driver was pissed and cussing at the guy on his way back to the car as I pulled away…

The moral of the story control your passengers’ too.


How does one control an ******* buddy from the backseat of your car? It's unfair to penalize one person for what another does. Why didn't you yank the fool who was flipping you off outta' the back seat and teach him something? How would you like it if you were screwed because of an idiot friend of yours that you have no control over?
Because yanking the fool out of the back seat and teaching him something would get an officer accused of brutality or some such nonsense. Writing the drive the ticket was the appropriate response because the driver had the ticket coming anyway, the cop is being nice and providing a warning. I suspect the "friend" will get taughthis lesson by the driver in the form of getting put out of the car on the spot and receipt of a serious a$$ kicking.

I would still like to know how the person who you had in your patrol car could have controlledthe backseat passenger in his car. Threaten to kick his a$$ throughMental Telepathy? How can you possibly hold someone resposible for anothers' actions? That is as unjust as you can get.

Back in the days, I had a couple incidents where I was going to issue a simple warning until the passenger piped-up and cost the driver big time. I agree, learn to control your passengers. You can cuss me out, give me the finger or whatever as much as you want when I can't see or hear you, but do it when I can, and it'll cost you...
So you stop someone and you and another Officer confront the individual. The partner uses excessive force and you witness it.Should you be blamed because youdidn't do anything? It is the same thing, you can control your own actions butyou say to learn to control your passengers! Come on...
