I can't remember if it was a washer or some form of a bracket (as you already stated)...but I had forgot to install it...saw it sitting there after install...took the time to put it on ...no issues here

Another solution is to get floorboard extenders that move the brackets out. These mount between the bracket and the frame.

I've got the floorboard extenders (1") and it helped with the clearance. It seems to be a common issue with Vance and Hines with real close tolerances. My VHDDs bring the 4" Rhine's super close to my rear spindle nut. It used to clear real well with the stock header. My friend put the same pipes on his stock header and there's plenty of clearance. Mine are right up against the nut with barely any light between em....always bothers me to see that.

I am not sure if that bolt is supposed to be tight - are you talking about the pivot for the footboard? If not, can you cut the bolt head or nut off with a grinding wheel/dremel tool/hack saw blade/chisel?

You need a 1/2" spacer on the front and rear mounting bolts. Spacer goes between the bracket and the frame. The bolt your fiddling with under the footboard has a lock nut on it and isn't supposed to be tight...only snug so the board can swivel if need be.
