rear fender brace

Default rear fender brace
I just swapped out my stock fender on my 04 Sporty for a new chopped rear fender. I kept the rear fender mud flap and rear fender brace. I was able to put the mud flap with no problem. However, the rear fender brace has become a problem. I can use the stock screw and nut to hold it on the sides but there is nothing to keep it in place on the top. Are rear fender braces absolutely necessary?
