There are plenty of options though:
1) Turn it off using your tuner if it allows that
2) Pull the valve open and use a sheet metal screw to keep it there
3) Replace the stupid damn exhaust and discard the servo motor unit (that was my solution)
I am in the UK and have never been pulled for my exhaust noise and it's a pretty loud D&D Bob Cat.
I've also ridden the bike for several thousand miles through France, Belgium, Luxembourg and Germany and again never been pulled. However I am sure the bike is technically illegal in those countries.
So the trick switch is a good solution if you live there, want to keep the stock exhaust, stay (more or less) legal AND have the bike sound better.
But if you want the best sound, the stock HD pipe needs to go!

I do not know if you guys in the states have this on your rides, here in Europe we all have it, basically it opens and closes the butterfly in the exhaust, closed keeps the noise down, and open gets more noise, well I just found a great little piece of kit for not to many euros, I paid €75 shipped to the door, well it is a trick box, that allows you to keep open the exhaust actuator valve to have the ride sounding like a Harley, and when the cops pull you over for a sound check, you flip the switch, and it closes the valve and your ride becomes a hell of a lot quieter, and you ride away with no fine, I got it in Germany, all is in German but it is just plug and ride.
