No, its a tiny angle at that distance. No issues at all. I am using Cometic C9247 Exhaust Gaskets - which are basically like SE gaskets, but twice as thick. So they conform nicely. But again, at that distance its probably a percent of a degree so no worries there.
Finally got this done yesterday. Ended up using a 1/4 spacer from the company you recommended. Turned out nice and gave the back the clearance it needed. Thanks again @Mchad

I thought I'd update this post a year on since I had a 2nd clearance issue. Once I got the Thunderheader mounted the lower shock bolt was just making contact with the pipe in the mounted riding position and it became actual contact as the suspension sagged/extended. I added BungKing rear sliders this year and contacted Legends to order the proper kit to mount them up to the Revo-ARC's. After I got the kit and really started analizing everything I noticed that the inner spacers they provide are thicker than they need to be, IMO. So, I contacted Legends and here is the response:
You can use shorter spacers as long as your spherical bearings can still pivot freely on their spherical bearings. We don't recommend running extended shocks with longer exhausts specifically for that reason, but if you can get away with shorter spacers that don't solid mount the shocks you should be fine.
Armed with that information I ordered some new spacers from Aluminumspacers.com (thanks again @Mchad ) in 3/4 OD x .509 ID x 1/4 and they work perfectly. Bearings move freely and it gave me the extra space I needed to clear the Thunderheader, even at full sag. Makes you wonder, instead of telling customers not to use their shocks with long pipes, why don't they just change the supplied spacers? What do I know?

Bottom shock mount. You can see the old contact point on the pipe, that shows how much space I was able to gain! I also switched from a hex head ARP bolt, to a 12pt also to gain a bit more clearance. That picture also shows how much extension of the shock was being blocked when the bolt made contact.
Clearance on bottom bolt and muffler at full sag. It was impossible to get a picture that clearly shows the space, there is a hair more than a 1/4" of gap, more than enough since I don't ever intend the shocks to be at full sag while I'm on the damn bike.
For reference, the setup guide from Legends to mount the BungKing slider. The blue highlighted "Legend Supplied Aluminum Spacer" on the right is the one I replaced (top and bottom) with my "custom" 1/4" thick solution.
