Sounds like they owned up to doing it so they will probably make it right. Maybe I just don't have the same attachment to my bike but I think ya'll get pissed way too easy.
I can't believe what you said. A bike should never be touched by ANYONEwithout permission. My bike is the only thing I have that is mine only.That means no one else touches it,sits on it or anything,with out MY permission.I would be way pissed,and I would charge him with attempted theft.
In high school we picked up and moved a volkswagen beetle about ten yards. Someone turned the guys in that they recognized,and they got charged with stealing a car.
Lot of folks out there that don't know about the don't touch the bike rule. I'm just saying to save the ranting and raving for when and if they don't come through with an acceptable solution. It's not the container of his soul, it wasn't his child, it's a motorcycle. Theft? He didn't steal it, and he wasn't trying to steal it, he dropped it.
Well I've cooled down some, Yeah the bike was covered and the blacktop people will cut me a check to pay the deductible so far, the fall totaled out the fuel injection system not to mention the mirror handlebar a/c and throttle and in my opinion my bike will be a piece of $hit from now on. I will know more on Monday after the shop gives me the finale cost.
What can I say that has not been said above...........if it was a car, would this ******* have gotten inside and moved it? of course not. What's the difference?
F--k them, get the highest estimate that you can get and tell the company to pay for it or see you in court. They damn sure won't go to court, they know they will loose.
And just for good measure, I would insist that as part of the settlement, they agree to fire the bastard that did it AND the forman on that job.
Maybe the next time they won't touch a mans scoot.

He could easily have theft added,as a leverage,if he needed it,then drop the charge later. But they are paying,so it does'nt matter anyway.

They are paying the deductable?? Do you realize your ins could go up because of this? Or if something else happens down the road they could cancel you for having too many claims? No way would I let this go through my ins company. They should pay for it in full.

I agree with this, except, I"m pretty sure your insurance will go up instead of could. The company is liable for the full amount of damages, not just your deductable. If you only had liability on it, would that absolve them of paying anything due to a lack of a deductable?
I would not put it through my own insurance, in addition I would charge them for all of my time spent dealing with the situation, I would get a quote to fix it and then add on a reasonable amount of time to spent dealing with it at a reasonable rate (which would be whatever you make per hour) Why should you be put out to deal with their screw-up? I'd be pissed too but I'd make them pay for all my time!
Yes, do not let your insurance company pay this claim. They're at fault.
Your insurance company will pay the claim, attempt to subrogate the costs...etc, however you do not want a claim in your loss history unecessarily.
Tell them that's why they have insurance, for when things like this happen. Tell them to file a claim, and pay their own damn deductible. That way your loss history stays clean, and your insurance company has no reason to surcharge you.
+1,2, & 3, it should go through your ins. if it was your fault and through theirs if it was their fault. No brainer. They owe you more than your deductable. If you had no ins at all would they be off scott free? Don't settle for that, and I agree about getting something for your time spent dealing with all this. Good Luck,
