I need your guys thoughs here as I am uncertian to what I am going to do. I live in Jackson, Ga and as I was turning into my drive way I was rear ended and taken off the bike. I have a lot of cosmetic damage and the bike is getting towed to the shop tomorrow morning to get fixed. What I am puzzled with is how the office handled the situation. First he talked to me for a second never asked you OK and went to talking to the lady that hit me. Then said that she was at fault for following to close, but do to no major injuries he was not giving her a citation? Really?? Then he said here is my card and that the two of you need to exchange insurance information and was do?? It has been awhile since I have been in a accident, but this don't feel right. I am thinking about getting a lawyer?

As long as you have a report # from the cop stating she was at fault just call her insurance and give them that info and they should take care of it. Don't talk to them about the accident or give them a statement without a lawyer though. If they even ask for one. If they don't make you feel comfortable that it will be taken care of then get a lawyer.
different states handle accidents different.. on private property, no ticket is issued, because police only patrol public roads. could be because it was in your drive,or ended up that way?? i was in an accident in TENN. i was in a semi, a girl from Florida in a little Toyota cut me off then got on the brakes. i put her bumper in the backseat. since Florida is a no fault state, and my only damage was a scratched bumper.. no ticket, no report, no insurance swap. the police sent me on my way.said if i wanted a report,i had to go make one at the police station. no time for that, i never heard a thing about it again... hope they take care of your bike, and your suffering. don't forget to tell the ins company motorcycling was your favorite past time, and reason for living. now your too afraid to ride any more since the accident.
Hate to hear about your accident, but glad you're OK. I had a lady rear end me at a traffic light when my brand friggin new 2010 FXDC was 4 days old. Instead of going back with the stock tail light, I opted for the HD LED model. I then added a RBT module & converted my rear signals to retina burning LEDs. Since then, there has been a noticeable reduction in tailgaters, and cagers very often leave a car length of space behind me at traffic lights/signs. They are that bright. Best mod you can make to your bike. Hope you are back in the saddle soon.
Glad you walked away, man. As for getting your scoot patched up, I would make sure everything is handled by HER insurance and not even contact yours if I were you. With a police report stating her fault, there is no need for your insurance to get involved, even if her insurance covers it 100%, yours will be affected and could cause for your rates to increase in the future. I know this from experience. I would only call your insurance provider if her end tries to balk at their responsibility. Also, hope that she hasn't already called your provider and thrown a wrench into that whole set of gears, especially if she lies to them like the jerk that T boned me!
However...the LEO still wrote their report b/c they were called to the scene. Go to the officiating PD & get cy of report...should state part of "following close" & you as victim. If not - address w/PD supervisor. Ins. co. will take care of the rest.
Also, btw, glad you're OK & bike will be re-built to ride another day.
