I was rear ended three years ago this December which totaled my Ducati 1198. It was a teenager texting but fortunately I saw her coming and had started moving prior to the impact. To make a long story short I was up over the truck in front which my bike landed in the bed of and other than a strained back, a few bruises and scrapes I was OK because of the gear I was wearing. Insurance offered, 14K on a 24K bike (4000 miles) + 2K in leathers, boots and helmet. I gave them the phone number to an attorney I retained for just such a case and within a week I had a check for the 26K plus medical expenses and a small lawyer fee.

I can't stress the importance of getting checked out by a doctor and retaining legal counsel just in case. Don't talk to anyone from their insurance company until you have.

Unless you had 10 lbs in the rear tire that's a pretty hard hit to bend the rim. Notify the dealership to look very closely at the trans case, engine case, swingarm and shocks. I've seen the trans case break where it attaches to the swingarm from a softer hit than that.
The smoke was likely from oil getting in the top end from it laying on its side.

Thanks again for all the warm wishes. Yeah, the driver had to have been pre occupied with something else, I was stopped in my lane for a good 30 sec, and its a long road, if he had looked up at all the last quarter mile he was driving, he would have seen me. It was actually light outside too when it happened. There was absolutely no excuse. I am being told by a lot of people to get a lawyer... I have my hesitancy towards that just due to all the seemly complicated things it may bring up. Not sure if it would be worth all the trouble. But, not sure tho. Medically I feel ok, just really stiff and sore. And my bike is pending frame damage to determine if its totalled or not... The dealership is picking it up tomorrow afternoon and hopes to tear into it Thursday. So I should know by then. Still not sure if I want to go through all the effort of doctors and lawyers tho...

Sounds like one I had in a car, woman plowed into the back end of me when I'd been sitting for about half a red light. She told the cop she didn't see me, and he asked her what about the red light. "What light?" He gave her a nice collection of tickets... When they're that ignorant of the world around them, what chance do bikes have? And that was a long time before cell phones, too.

I would get the chassis checked as well....Remember that the the force of the impact goes through the rear wheel, into your swingarm and then into the rest of the chassis, so you could have unseen/unseeable frame damage as well.

The oil puffs are most likely nothing to worry abou as the bike has been on its side and oil could easily drain into the jugs.

Glad to hear your okay though.

So dealer finished up the repair quote.... After labor, just a hair above 9 grand. The adjuster is going out tomorrow to sign off on it. Still not sure if he's going to total it or not....
Among the scratch and dents, it sustained massive frame damage to the rear of the bike, its beyond repair, and would require a whole new frame, salvaging the motor and trans from my bike, pretty much everything else will be new.
Also, turns out dudes insurance lapsed back in april so, my insurance is going to be taking the repairs on their own, minus the $500 deductible... And I'm on my own for medical help.... didn't opt for uninsured motorist coverage.
FML.
