Looking at a 1950 WL45 flathead. Current owner has title from previous owner who died but title is not in current owners name. Current owner says he has death certificate and bill of sale and all required paperwork. What can I do to research ownership and be sure it’s not stolen and ensure a safe transaction?
1. Tell the person who has the bike to get clear title in his name, until that happens he is not the owner.
2. If he is not willing or does not get the title in his name walk and look elsewhere.
3. He is trying to avoid taxes and title fees and may not be the owner of the motorcycle.
4. Do not proceed with any other negotiations until #1 is accomplished.
5. Consult with your local department of motor vehicles about titling and registration.
A friend of mine went through this recently. He contacted the probate office in the last owner's town and they verified the seller is the executor of the estate and authorized to sell the car in question.
Start with your local DMV, I basically had the same back story when I bought my bike 10 years ago. They will tell you what to do, response will vary by State, I did not need to have seller register before I could register it.. If you know anyone in law enforcement, running the VIN is good for piece of mind, but things are so old it might not show anything even if there is an issue. Post a pic of the VIN#, couple of experts here that can confirm if it is at least a factory number, good luck.
