I believe it is a felony in all 50 states to leave the scene of an accident and some states have a minimum jail sentence if there are injuries as a result.

Most of the time, when someone flees the scene, they are either an illegal citizen, have no DL, or are under the influence.

Actually, lane spitting is not legal. Not at the 50+mph you were doing. While the car was in the wrong for crossing a double line, you were the one at fault and can completely avoid a similar accident in the future.

I'm glad you're okay and doing well, but you won't be for long if you keep riding like an idiot.

Sounds like the crash is primarily your fault. Cage driver contributed to the cause by changing lanes over the double yellow. Sounds like you were splitting on a double yellow, pretty sure that is illegal.
With a one month old bike, you are probably upside down on your loan. It depends on how much of a down payment you made when you bought the bike.
Hard lesson but never ride when you are "late for work", your common sense mindset ceases and you take chances that will get you hurt.
Here is the law about driving over double yellow lines..
V C Section 21460 Double Lines


Double Lines

21460. (a) If double parallel solid yellow lines are in place, a person driving a vehicle shall not drive to the left of the lines, except as permitted in this section.


(b) If double parallel solid white lines are in place, a person driving a vehicle shall not cross any part of those double solid white lines, except as permitted in this section or Section 21655.8.

((c) If the double parallel lines, one of which is broken, are in place, a person driving a vehicle shall not drive to the left of the lines, except as follows:

(1) If the driver is on the side of the roadway in which the broken line is in place, the driver may cross over the double lines or drive to the left of the double lines when overtaking or passing other vehicles.

(2) As provided in Section 21460.5.

(d) The markings as specified in subdivision (a), (b), or (c) do not prohibit a driver from crossing the marking if (1) turning to the left at an intersection or into or out of a driveway or private road, or (2) making a Uturn under the rules governing that turn, and the markings shall be disregarded when authorized signs have been erected designating offcenter traffic lanes as permitted pursuant to Section 21657.

(e) Raised pavement markers may be used to simulate painted lines described in this section if the markers are placed in accordance with standards established by the Department of Transportation.

I agree its not "officially" legal, but It is not specified as being illegal. I've done it in front of Sheriffs, CHP, and even allowed officers behind me to pass. I've even had police official more to give me room to pass. Bottom line is, if people would just not cross DOUBLE marked lines there wouldn't have been an accident. Yes, if I were traveling a lot slower I could of avoided it, but I've already said I was going too fast, that I already admitted. But illegal it is not or there would be a **** load of motorcyclists in CA being pulled over every day which isn't the case.

And btw, yes I do intend to slow down, WAY down. I like to ride and want to continue to do so. And I agree, I was being an idiot.

Have a Hero3 on layaway at a pawn shop. But to be honest, I'm not sure I'd want to relive that over and over again. I already have the last few moments before impact and it freaked me out for the first few nights.

Splitting lanes should be less than 10 mph. The concept is for near stagnant car traffic over heating air cooled motorcycle engines. So all those water cooled bikes should be removed from this exception. Only air cooled bikes should be able to lane split at an extremely low speed.

I'm glad you are ok, I really am, but that's reckless driving (lane splitting) no matter if it's legal or not. It is also considered aggressive driving. Cyclists should drive defensively, always. It's the only way to stay safe with so many incompetent drivers around you at any given moment.
