Around here, it is quite common to buy a used bike that comes with a helmet.
According to the OP. The extra parts were handed to him in a box. The helmets were discovered later in the tour pak. That is why I asked if there was any discussion of why the bike was being sold.
If the guy finally got the deal done on a new bike two weeks later. Is it not reasonable to think that was the first time he went looking for the helmets. Not likely that someone buys two new helmets and decides to never ride again.

I would not have wanted them back if the person had been using them. Especially with the temps we been having so far this summer.

Beating a dead horse here - but you didn't put the helmets in the tour pac and you told the man the truth that you thought they were included with the sale along with the other items, you wore them and offered to return them - he declined.
I'd sleep well at night if I were you

ugh, I always used to want to buy private party to save money, but now I'm seeing the value dealers provide. So many weird situations and wackjob sellers.

Would you want a helmet that someone has been using for a couple weeks in 90+ temps? Not me.
If a cashier handed you too much change would you keep it? Character check time.
I wonder how some of the answers would be if the role was reversed and the OP's helmets had been left in the tour pak.
Or possibly the bike was traded in at a dealership and the helmets left in the tour pak.
I don't think we are getting the whole story from the OP.

I am the op.
The seller was getting rid of his HD because he wasn't riding anymore.

What he gave me was not a box of junk. It was all the original parts that had been replaced along with an extra seat. I honestly believe he was purging all things Harley.

I only posted in the first place because of a boring rainy afternoon. I wasn't looking for absolution, just sharing my experience.

I do sleep very well. I offered to return them. I feel no further obligation.
