Default Weird purchase situation

I recently sold my '96 Heritage to move up to a bagger.
I found a 2005 Electra Glide Classic with a lot of mods already done. Bike looks and rides great.
Here is the odd thing... When I test rode it, the tour pak was empty. When I went to pick it up, the previous owner gave me a large box filled with the original gauges, turn signals, shocks, etc. he also gave me an extra seat and windshield. There were also 2 new looking HD helmets in the tour pak. Since we were planning on getting new helmets anyway, and they appeared brand new ( wife is very fussy about used gear), we began wearing them. About 2 weeks later, I get a text from the previous owner who asks if his helmets accidentally got left on the bike.

I told him yes, I was sorry, we have been wearing them since we thought they were included. I offered to deliver them to him. He declined and said he didn't want them if we had worn them. He was polite about it but it was clear from his texts that he thought I somehow took advantage of him.

I feel I made a valid assumption, offered to return them, and have no other obligation. Thoughts?

Wouldn't worry about it. His wife was probably "very fussy" about him giving away their new helmets and let him know about it. Wives are like that.

The helmet fairy didn't put those in the tour pac. You offered to return them and he declined. He made a mistake and laid a guilt trip on you. He'll get over it, maybe his wife won't but it's not your fault or your problem.

It was his oversight putting the helmets in the tour pak. You were kind enough to offer to return them. If he declines then it's his loss. If it was me, I'd be over it by now. Enjoy your new ride.

Wait a week, he'll be calling you to see if he accidentally left a box of gauges in the tour pak.

Being you were going to buy a new helmet anyway you could have made a half hearted offer.

I totally agree.. The fact that you offered to return them was enough. He should also not have left anything in the bike that wasn't going with it.. He knew the helmets were in there when anything else was put in. What the heck.

Seller beware! But, since he did seem to be a decent guy and give you all the other stuff he could have sold on e-bay and since you were going to buy new helmets anyway I do think an offer to help buy new for him and his wife would be a noble offer. But you're under absolutely no obligation IMHO.

He probably took it out for one last ride with the old lady and out of habit put the helmets in the TP. If it were me under the circumstances you described I would offer to split cost. Pay for one new helmet and he could buy the other. That is if he wasn't copping an attitude.

You got more than you bargained for with helmets and extra parts. If he had a pissy attitude I would tell him to pound sand. Either way you're under no obligation after the fact, your call. JMO

You had them two weeks, wore them a few times and you're supposed to replace them??? Nope... not unless you dragged 'em down the road or did a few motos in mud .. You offered to return them. That's enough..
