Default I Was Sold Used as New - What Would You Do?

After much forum research, I decided to replace the rear shocks on my Sportster. Called one of this forum's featured sponsors after ensuring their website mentioned "new" product. Now my installing mechanic tells me he thinks they were used. Here's his answer when I asked what made him think that:

"The shock box did not include an instruction
sheet, the washers that were in there were
clearly used (misshapen, discolored, etc.),
and the shocks have some scratches, etc.
Also, the shocks weren't wrapped at all,
just laying in the box. There are some
marks on the chrome from them rolling
around in there. Nothing anyone would
notice, only me as the installer and you
after I point them out to you! The shocks
don't exactly look like they've been on
a bike and ridden lots of miles, perhaps
they were on a bike for only a short while
or on display. ??"

So, what would you do? The shocks, seat and saddlebags are all reinstalled so it would be a pain to redo everything. If it rides nice should I not worry about it? Should I insist on a reimbursement of some type? Thanks for any advice.

I would call the vendor and express your concerns. Right now it seems as if you are relying on your installers "hunch" about the shocks.
I would get some first hand info and if you are not satisfied then express that to the vendor and try to resolve the issue. I think if it were me it would eat away at me a little, and would want an answer as to whether or not the were in fact used. Best thing to do would be go to the source and find out for certain... You know what happens when you assume!!

I would contact the sponsor & tell them your issues.If their reputable they should do you right.

wow, who was the vendor?? I seem to recall a few months ago someone bought shocks from a vendor and they were used also. I dont remember the name of the company though. Anyone else remember that post??

I would call/confront the vendor and ask WTF.

Somebody probably ordered the shocks and found they would not fit and reboxed them and sent them back.The vendor should have made sure everything was in like new condition before he resold them.Yes,you are due something for this,for example a discount refund on this purchase.

I'm going to withhold the vendor's name until I talk to them and see how they resolve this. Don't want to smear anyone's name when I could be jumping to conclusions here.

thats respectable, I tried a quick search of the post I remember reading...nada. But it would be informative to all if it were the same vendor that is doing this. Good luck in your resolving this.

I would definately call them up and see if they tried to make it right and if not give everyone a heads up about the vendor.

I think that if it's supposed to be new then all the wrapping and protection that the manufacturer packages their product with should be on the unit. If it was an 'open box' item it should have been mentioned prior to sale.
If you want to keep the item I'd ask for some kind of open box discount/rebate since the used part wasn't mentioned. If it's a retail store I would imagine there are things that can be done if they aren't cooperative. I personally won't do business with someone that is deceptive.
I would check for recalls on the same item and see if it was returned possibly for a reason like that.
If there is a problem let the forum know and we can drop some emails on them before anything serious has to happen.
