Might b diff in your locale but I think unless you specified the dep. was non refundable you have to return it.Plus the deal with your wife's working with her hubby has to come into play as well.

unless you gave her a contract with a non refundable deposit give it back to her I know it su*ks but move on if she winds up taking you to small claims you will have to give it back + intrest

How did you earn it? That's what a judge is going to ask you when this ends up in court. You will, in all likelyhood, end up giving them their money back. You hate to cause ill will? That's all you're going to do if they have to take you to court to get their money back.

Generally if I were to give someone a deposit and change my mind, I wouldn't ask for it back because they held up their end of the deal. \\;But if they sell it out from under me I'd expect it back for the same reason. But in the grand scheme of things it's not worth the potential grief for you to keep it in this situation.
