Default what should i do after accident ?

3 weeks ago a truck went thru a flashing red light and wiped me out...iam at home with 7 broken ribs. here in michigan we have no fault insurance, which means my insurance pays to fix my bike. his insurance fixes his truck, and pays my medical bills and loss of wages..i have Progressive insurance, they have already written me and local H.D. shop a check for $9000 to repair my bike. no frame damage, all cosmetic....i still havent heard from this guy insurance, getting where it would be nice to get some money for lost wages and medical bills..Progressive hasent even seen the police report as either have i.do i need to get a lawyer ? does this stuff take this much time? what kind of compensation can i expect ? should i go lean on sherriff dept. to release accident repot ?

Your number one job is to heal up. Number two is to keep you affairs in order. If you can reach out to your Progressive Claims rep (their phone number should be easily available) they can advise on your medical payments. Loss of wages is something completely different though. I would say that you may need to get the advise of an attorney that specializes in personal injury. I am not an attorney, nor do I play one on the internet, however many of my friends are. I am not litigious in nature so I have often discussed with my personal injury attorney friends about how the insurance companies try to get out of paying valid claims. Therefore, it is good to have someone on your side to take care of your affairs. These guys work for free and get paid based on what they recover for you. As long as you and your attorney are fair in your dealing and not looking to get rich by making false claims and statements you are not being a weight on the system either. Good luck to you. In my state, you usually have access to a copy of an accident report in 3 days. You need to contact the Sheriff's Office and tell they you want a copy of the accident report for insurance purposes. Most insurance company that I've know of, generally will not voluntarily release money to you if there are injuries with medical bills. You could need medical attention later and the insurance company aren't prepared to settle up in most cases unless you get an attorney, and in most cases, that what happens because the insurance companies want to hang onto their money as long as they can.

Sorry to hear about your accident,hope your doing ok.

The drivers insurance co. wont do anything without the police report.I would contact the PD and see whats up.
Seems like they should also pony up for some pain/suffering payment also.
Would not hurt to contact an injury attorney for a free consult.

Sorry to hear of your accident! Broken ribs definitely suck!

Job #1; get healed up!

Even in No-Fault states there is a requirement for the offending party's insurance company to make contact with you/your insurance company & law enforcement within a certain time period.

Good luck getting healed up and back on the road!

Like has been said, your insurance company should do the leg work for you. If thats not working for you, contact an attorney. Glad your ok.

Same here. You have to go get a copy of the accident report.

I hope you heal up quickly.

Where I live it takes 7 days to get an accident report. Get it and if you want any extra money you will need an attorney. He will probably end up with 60% of the money, it's a racket. Usually a consultaion the first time is free.

I had a laywer last summer write a threatning letter for $75. It never got me anymore money, but the freakin adjuster would answer my phone calls after he got the letter.

Glad you are OK, even being able to get on this forum is a miracle after a bike accident. I hate to be the barier of bad news but usually you don't get any money for your lost time, medical bills, etc. until this guys (or yours) agrees to an amount and settles with you. The last (and only) time I have had a deal like this it took 18 months to get any money. This is why it is so important to have some kind of disability deal ie: The "Aflac" Duck, and NO I am not in the insurance business but as a bike rider we need to be more prepaired for injury based accidents.
