I'll agree that carrying a beer can around isn't very smart, but your responses are way over the top. Having a beer is not against the law. Driving/riding while over the legal limit is. Obviously, they did not suspect or find the OP to be over the legal limit. So, what is your beef? FWIW, I do not drink and do not want to be on the road with drunks.

The beef is the drinking and riding does not mix. And I would not want to get taken out buy some guy that does not realize that. Here is the big city we have traffic and distracted riders, in Wiscosin you have deer all over the place.
Me personally it is shame they did pursue the ticket. I would have enjoyed being in the court gallery to hear the OP present his defense.

First I do not condone drinking alcohol and driving in any way shape or form but it should not be a crime that you have an empty alcohol container in your possession. If a law enforcement officer thinks you are drunk then they should be giving you a field sobriety test not giving out open container tickets. What is more if I read adamsthephoneguy original post right the cop would not have known whether he had picked up the can off the ground or out of his saddle bag.
