Default Question for those who have gotten into MC accidents.

To make a long story short. I was cruising along on the freeway in the #1 lane @ around 40mph. (traffic was a little thick), Some lady, for whatever reason, decided she wanted to get into my lane and she took me down.

After dealing with her insurance (wawanesa) for the past few weeks, they have finally decided to take liability for the accident. On Monday they (wawanesa) came out to my house to inspect my bike and take pics of the damage. So now im being told that my bike is a "total loss" (which i dont think is true)..

Damages consist of bent bars, bent brake pedal/floorboard, a few chrome pieces need to get repalced. got an estamite of around $3,000-4,000 to get it fixed.

So my question is, How does this process work? I have a loan on my bike for $13,000 and im thinking Im going to be bike-less, and still have a balance on my loan that ill have to pay? Can someone thats gone thru this help me out. How should i go about this?

I'm in the same situation to my comments would be most current and also reliable (caveat emptor) as I've spent countless hours researching and speaking with insurance and also others that have been down.

Savage (total loss payout) is only if you have damages over half of the value of you bike inclusive of all the accessories on it (this is accountable up to the total amount of accessory coverage that you posses!)

If they do not want to pay you to fix your bike and you want to have it fixed instead of getting a new harley, take the case to court and have a judge decided it. you will go to small claims and file suit to wanemama company. more likely than not they will get scared of the potential legal fees and time spent fighting the case and just do whatever you desire.

If they pay total loss, you should get more than what your harley is really worth. not a lot more, but maybe 1-2k more than value. looking at ur bike i think u may not want that?

also, you should have reported it to your insurance company and have em submit a claim. if the other company doesn't pay to fix your motorcycle or doesn't pay enough to savage the title, ur insurance will sue them and the lady to get full payment, which is more than enough for whatever you want to do.

fck em and claim as much as you can. call insurance tmr (your own) and claim for your helmet and whatever else was damaged during the crash.

also i hope you asked for inconvenience and injury (if u are injure).

Amazing how little it takes for a total loss,I see it all the time with the salvaged frames I have been buying so far have not found a thing wrong with them.

I can tell you that Insurance companies are not afraid of legal battles. Being in court is second nature for them. They have a team of lawyers on staff full time to manage everything that is happening. What the Insurance company will do is look for ways to minimize their losses. Both time and money.

You may get a claims adjuster that will obtain a police report and view the bike and determine total loss so he can make it to the golf course on time or you may get an adjuster that actually takes the time to interview the parties involved in the accident, contact witnesses, etc, etc. Either way, if you are not satisfied with the determination, contact your own ins company and tell them your concerns. You have a nice looking bike and I can see why you are not in a rush to accept total loss. Sometimes you gotta fight for whats right. Good Luck!

Don't settle!! Let your insurance look at the bike. That's what you pay them for. If you let them total it and get it back and repair it youeself you will have a salvage title.

FYI, whenever in an accident, say you are injured/hurt and try to make sure the police state that in their report. I know, I know but when dealing with scumbag lawyers and Insurance Co's you have to work at their level and a bargaining chip helps. It's a shame but it's what things are today.
I got FUBARED in 1990. I was 101% in the right but scum sucking lawyer from scumbag Ins.Co. tried to say it was my fault I was badly injured because I was wearing a DOT legal 1/2 helmet. Eventually I won but It was a long fight. Nuke all lawyers and the corrupted legal system.

I can't believe they're messing with you over 3-4 grand. I think you should sue them for the full cost of your repairs. It would be terrible for a nice machine like that to end up in a junk yard or something before its time.

If this all goes south for ya, maybe contact your states insurance regulatory commission/office, they may be the ones who decide whether that insurance company can do business in your state.
