I had the "no start in gear" problem on my Breakout until I realized that I'd covered the clutch lever with leather, and it was stopping it from hitting the switch plunger. Removed the leather and it still was iffy, so I glued a thin piece of metal to the edge that contacts the switch plunger, and now it works great. I think the problem most people have is that the switch contacts "relax" a bit and the lever doesn't push enough to make contact.
Mine acts up intermittently. Does it have to be acting up when taken in, or is there a stored code that the dealer can see it has failed? I have no intentions of dropping my bike off and let them ride it around till it acts up.
The switch is only like $12 or so, and it's easy to install, I have done it a couple times on different bikes. As a matter of fact I did it a few weeks ago on my 2011 Rocker. Of course if you are so inclined/And or under warranty you can replace the whole switch pack.

I've mine already replaced cruise was working but won't start some time in gear with clutch pulled in it's known to fail just take it in have the shop get you a new one.

wife's stopped working, they replaced the clutch switch housing under warranty..the replacement is failing intermittently..it failed in front of the service writer, they checked it in, it didn't throw a code, worked the next day so said no go on warranty replacement..I later had them call HD tech support to see what the process is..was told next time we bring it in reporting failure they will run some troubleshooting diagnostic steps..frustrating..service writer even said they have seen their share of these failures over the last year, not only clutch but right side housing as well
Bike info would help, as even though they all serve the same function, there is no telling if they are the same part number across the models and years...
