Since the day after the Consent Decree was signed I have stated that it (the Consent Decree) is a violation of Federal Law, and it is in direct contradiction with the Written HD Warranty.
At some point, someone will call them on it in court and it will get straightened out.
In the meantime, do what is best for your bike, according to the HD Warranty (not the illegal Consent Decree). To avoid any hassles, put it back to stock if you need to do a warranty claim on the engine.
So I don't want to junk this thread up and I am sorry if I am. You all are spot on with your data. Spoke to Harley's warranty department to ask some questions regarding this. They have a legal loop hole that gets them out of things and they are using that to determine if something is within their warranty guidelines. This is for the 2017 and 2018 bikes. The Harley rep stated that all modifications or changes to the bike need to be EPA compliant. If they are not EPA compliant it voids the warranty for that component. So if you put non EPA compliant exhaust on your bike, it voids the power train warranty in its entirety. I asked the lady, how does this comply with federal law. You can tell she has been trained for this question because she quickly replied with, we don't warranty motorcycles for racing or competition use. I made my case with her regarding exhaust. Her bottom line was all vehicles on the road must meet EPA requirements unless it is on the exception list, example 25 years or older. She then said if your HD motorcycle is not within EPA requirements, its not legal for street use so its treated as racing/closed course which their warranty does not cover. Smart on their part I must say. Would be very hard to win that case in court, unless you told on your self that you were not following EPA requirements. Would be like a drug dealer going to the cops saying he got robbed of his drugs lol.
Going to take my chances with a v&h tuner on my 17 heritage. My guess is, as LEAN as it is from the factory my cylinders and pistons will thank me later for the Vance and hines fuel tuner.

What is making you say your bike is lean? Did you get AFR readings on it?
Unlike the Twin Cams, this M8 was NOT running overly lean from factory. When we swapped out the stock faux "stage I" air cleaner with one of our true Stage I Air Cleaner Systems, it did amazingly well with NO change to the tune.

What is considered a good AFR range for harleys? I wasn't able to go to your link. For some reason it wouldn't pull anything up. I am familiar with cars but not sure about Harleys. Cars we would have around high 15 at idle, 14 at cruise, and 12 at full throttle.
That's huge info if the factory tune is no longer as terribly lean!
That's not to say they won't run better with an optimized tune, they will...but from what we've seen on the couple stock 2017 M8's we had on the sniffer, they do NOT have a lean problem.
We have not gotten a 2018 Softail M8 on the sniffer yet. Hopefully HD did not mess around and change it.

That's really close to what we look for. 14-14.5 cruising and 12-12.5 at WOT.
As you can see in the chart below, of a 2017 M8, it's in the low 12's with factory tune and factory A/C.
