The stock Heritage doesn't come with a driver's backrest.
You must have an upgraded seat.
If it's either a Harley Sundowner or Signature Series seat you can download the instructions from the Harley web site.
I recall having a difficult time figuring out how to pull the backrest off my Signature Series Seat but with the instructions I was eventually able to figure it out.
I'm not sure about the Sundowner, but on the Signature Series, if you run your finger down the front of the backrest post about an inch or two inside the seat you can find a small tab that sticks out. Push the backrest down with one hand and with your finger in the mounting hole push the tab toward the back of the bike. Once the tab goes in lift the backrest up and remove the it.

Welcome to the Forums from Central IL, if have a drivers backrest you definitely have an upgraded seat. Could be a Mustang also, figure out what seat you have and Google it.
If this is a Mustang seat you'll see the Mustang logo on the nose. If a Mustang driver backrest is stuck, the previous owner may have cinched the detent screw tight to keep it in place. Have a helper carefully tug down on the vinyl and foam behind the receiver, revealing the set screw. Go at it with a flat-headed screwdriver and you should be able to adjust it to the original setting. We can provide a replacement detent screw if it's been damaged.
