Firehousecustom.com I have one on my 09 Heritage and it does the job. Yes, it does fit with the passenger pillion, in fact you can't use it without it.
What do you mean it won't work without the passenger seat? Mine, and everyone else's I've talked to, will not work with the seat on, but works fine without the rear seat. It slides under the seat bolts, and there is nothing on mine that would prohibit you from using it without the rear seat. I am curious as to why yours is the opposite?

Can you put pics of your Heritage with the driver backrest and the passenger pillion?
Thanks
Our drivers backrest does work on the 2009/2010 models, however the bend in our current brackets doesn’t quite match up to the new passenger seats. It still works it just pushes in on your passenger seat a bit
What do you think about this? looks good?
