++ on the small claims court , then a big ft in there a**!! I see a lot of this in the past 30 + years with all our Bull Sh** laws now days people thing they can just do anything they want to anyone and get away with it with out anything happen to them!! Kinda like the way the drive down here in FL!! Sorry for the rant * just **** me off** Get in there face and tell them
They wont settle if they dont have the money. They will go to court, all they have to do is show up. Your the one out the attorney fees.
With that being said, I would sue. Who cares, what a **** hole shop. Post the name so we know. No need to protect them. I would blast them every chance I get.
You might consider trying to find an attorney who will work on a contingency basis. You win - or settle - they get 1/3. That way, you're not out any money at all, not a dime, and the attorney has incentive to go after them like a pit bull
DBrown: I'd rather be out $2,000 than laid up in a hospital bed or worse. Be positive with respect to that. In the matter of the shop, threaten to drag that *****'s a$$ through the mud. I'm in business myself and I'll tell you, reputation is everything. If you don't have a good name, you have nothing. I'd go to the shop and tell them in a nice way the screwed up. Ask them to split your costs and make it right. If not, you'll contact the BBB and consider small claims court. Add that you'll also post the shop's name on every motorcycle forum you know advising people of their incompetence.
I'm amazed when I see these kinds of complaints but there's no mention of the name of the offending party. If it is real, then make it real. Go to small claims court if the second shop will testify. If the second shop doesn't testify, guess what... their statement of what is wrong is no better than what the first shop said they did do that you say they didn't do.
It will be two to one and you will win something. If the second shop knows what they are doing then they will be glad to slam the first shop. If not, then it's all hot air and as usual its the customer that gets screwed. I have seen situations where the second shop fixed a lot more than was necessary and happened to luck into what was really wrong.
Letters to the editor in the local rag doesnt hurt you either...if others in the area had a bad experience as you did...they may come fwd as well...not to mention...possibly prevent others from goin to such a flim flam shop in the future. Good luck with with it all and please keep us posted!
