it wouldn't surprise me for them to take care of it, since its obviously most likely a manufacturing issue..

if it is an assembly/production issue, it also wouldn't surprise me that there are others out there, but no one has noticed them yet. when a part is made wrong, it generally isn't the only one.

I have almost 20k on it,been to Cal & back the last 2 years & about 1k on it this year.The bike runs true with no weird tracking.I'll be heading back out west for another 6k trip next week with the blessing of my local H.D. dealer. When I get back I'll hand it over to them & then they can do whats needed. Thanks for your input. Oh ya...I do have roadside assest.

Hello everyone!!! Here's an update on the swingarm problem that I had. I did go on my annual trip out west & had no problems with the bike. Soon as I got back home I handed the bike over to the local H.D dealer where I bought it so they could fix the swingarm. Turns out they had a representative from Harley look at it but said there was nothing Harley could do because the bike was considered 4 yrs. old even though it's a 09 model & it's still 2012. Once the 2013 models are produced the 09 is now 4 yrs. old-if it was 3 yrs. old I guess they wuold replace the swingarm on there dime. LUCKLY....I have the extended warranty which covered all parts & labor-less $50.00 for the use of the warranty. So now I have a new swingarm on the bike,the gap is correct on both sides & all is well again with the train.

glad it worked out for you.

you know i pondered the extended warranty when i bought my bike and i thought hey its a freekin bike not a car/truck most **** i can reach and if not oh well it is easy enough to take half the bike apart to fix things myself. and then i thought about the cost of replacing some items and knowing i am a high mileage rider i decided it would be a good idea to get the extended warranty.
hearing your story makes me glad i did :-)

Thanks...I'm glad too because the swingarm is a $840.00 item & then you have the labor. One thing that bothered me is that I only was able to get about 5-6k out of my rear tire (200/55r17). Now I put a new set of Michalin Comm. II's on before the trip & the rear is showing considerable wear even though it's claimed they get twice the milage of other tires. Did the swingarm being off center have something to do with lower milage? I guess I'll find out next year.

Dont think it caused early wear...

If U read or do a search on the 200/55/17 lop tire, most get between 4-6k on them..

I also just installed some new Commander II's with a little over 2k on them now..

U said above U were going on a 6k trip and did the tires before,, so now with 6k on them whatever U get from now on is a bonus to what Ur were getting with the Lops.

glad to see you got it fixed. so did they say what the problem with the arm was ? worn bushing, made wrong or what. i would have argued the out of warranty issue since it was well documented before the time lapse and the dealer told you to go ahead and ride until "convenient". if the part was made wrong from the git go, it didn't wear out. harley should have fixed it or at a minimum had the deduct waived in good faith.

just glad they got it fixed for you.

When they removed the old swingarm & inspected the bushings,bearings & cups there was no abnormal wear. The arm itself was manufactured out of square with a slite lean to the right which made it rub up against the frame. Your right about a manufacture defect that I felt should have been picked up by H.D. After I picked up the bike-with new arm installed-I protested to H.D.(written letter) about this very matter but at this time have not heard back.Still,I'm happy it only cost $50 & not $1050
