Welcome. Yes, that's a common problem. What brand seat? Sometimes, you just have to root around and make do. That's what I had to do with the same problem. You'll eventually find a way to make the seat fit, I promise.

thank you…aftermarket seat from eBay by a company called nicemotorjj (can’t remember the brand on the seat if memory as I’m at work on nightshift) the seat fits but it’s the control module that won’t let it sit flat
It's mounted in front of the battery now but for every improvement there is a downside. As it now sticks out sitting behind the rear cylinder it makes it difficult to get at the wiring for the starter motor and ground points.
The ECM in the rear fender only affects Sportster models from 2007, 2008 and 2009. There are aftermarket seats with a hollow in the base to accommodate the ECM on these model years. 2010 did not have the ECM mounted in the fender, the OP must have a 2009 Sportster which was registered in 2010.
