Default Dealership holding bike hostage

I bought a XL1200L four days ago. The bike is currently sitting in a mall on display, every time I talk to the dealership they tell me they are working on getting it out. The bike is mine free and clear I paided cash for it. Any advice

If you've got the Bill of Sale and the bike is legally yours, and sitting in the mall, go take it. It will cause a "stir" initially and bring the cops - but let 'em come.If you are truly the legal owner, I strongly suggest you get it out of there NOW! If anyone gets hurt by that bike in the mall you are negligent and responsible. To hell with what the dealer is saying - GO GET IT NOW!

I guess a lot would depend on the paperwork you have "in hand" and the fine print. Did you buy it from a dealer Rep. that was in the mall or from the dealer store and they just told you they have what you wanted on display in the mall? Do you know if the bike is fully preped? If the bike is preped and you have clear title of ownership you have the right to take it from the mall, although I would call the local LEO office first and ask for an escort out of the mall.

This is SO TYPICAL of Harley Dealers...if it were a Car Dealer you coulda waited an hour and had your new vehicle...but never at a Harley Dealer.If I were you..first thing Monday Morning I'd either be at the Dealership or on the phone to the General Manager there telling them you want your money back..TODAY.They are taking advantage of you...actually to the point of abuseing you. I take it your female from your screen name...this is more of the old she's a chick and we're not so we can do her any old way.DO NOT ACCEPT THIS...get your money back and go some place where they actually want your business...dont take no for an answer.If they're being this way over selling you the Bike..how are they gonna treat you when you have a problem with the Bike??..or when you come to service the Bike?? GET YOUR MONEY BACK AND TAKE YOUR BUSINESS ELSEWHERE. that is my advice and how I would handle the situation.

Well said. I certainly would NEVER get my bike serviced there or let them do any warranty work. What's this dealer's name? I think we all ought to know so we can all treat him as well as he's treating you!

OK first dont go in the mall and get it. malls have rules for displays. rather the bike is yours or not you could still get arrested for disturbing the peace. ont eh contract it should have a delivery date or the date you are taking possession. rather you have paid for or not the bike is not yours until after this date. If the bike is yours and you have read all of the contract fine print, talk to theowner and/or general manager. Call MOCO ont he phone and ask them why. I really think after four days and my stress level going up i would try and break the contract with them and get my money back.
buying a harley should be fun a day to reflect on the way it made you feel. it should not **** you off everytime think about it.

Before you go in there, guns a blazing, I'd try to figure out what is going on. Maybe its just me, but it's hard for me to read what amounts to, at best, four sentences, and conclude that this is another case of a dealership that is the spawn of satan and lives only to inconvenience you, take your money, and generally be as unhelpful as possible. I assure you that among the Harley dealers across the US, very few suck that bad. And those that do are fast in the process of coming under new ownership. You just don't stay in business that way. Besides, if the dealer you bought this bike from really sucked that bad, you would have sensed that right away and not bought from them. Give yourself some credit. You initial reaction must count for something. Give them a chance to explain and make it right before you shoot them in the face.

Before anyone, here or otherwise, can be expected to provide any meaningful recommendations in your particular situation, there are several unanswered questions that should be addressed. Among them......

Was there an agreed upon time and date that you would take delivery? When? Has that time passed? What was the reason given for the delay? Do you have a license (can you ride) or are they supposed to deliver the bike to your home? What does your paperwork state? Was there any discussion about how long it was going to take to get it out of the mall, prepped, setup, etc? Who specifically were you speaking to at the dealer? Was it someone that had specific knowledge of your situation?

I am not saying you did anything wrong here. But neither am I sticking up for the dealership. I will say again that there is far too little information provided in order for anyone here to make an educated, well-informed assessment, much less a recommendation to you for a course of action short of suggesting you speak with the salesman and dealer general manager, in person, in order to rectify your situation.

Yelling, screaming, demanding your money back, threatening BBB involvement, or the use of an attorney is far too excessive at this point. Escalation of force; don’t get nasty until you need to. The Harley experience should be about building bridges, not burning them down.
