Like everyone else, glad you're reletivelly OK. Hate to see the bike in that kid of shape, but it can be fixed. Take care of that arm!

Glad you are OK. The only thing I can say is if you are injured and are going to miss work get an attorney. I use to be very anti-attorney unless absolutely required, but recent experience with accidents and insurance companies has made me change my mind. The ones I have delt with have done everything they can to screw the victim.

This is good advice. I'm a paralegal in a pi firm. The insurance companies now use a computer program called Collossis (Hope I spelled that right). The sole purpose of this program is to lowball people with claims and they have NO problem trying to pay off as little as possible. Some companies are far worse than others. There have been several major lawsuits over the use of this program in our state. But the insurance companies continue to use it. Its sad really when we pay all these premiums for insurance and when we NEED it we get hassled.

I'm a retired insuranceclaims manager and I will give you my .02 worth of advice.

Do not run out and get an attorney from the get go. Wait and listen to what the other insurance company has to say. Every state has a statute of limitations. That is the amount of time you have to either settle a claim or file suit. They tend to run two to three years. Your agent or claims department will be happy to tell you what the statue of limitationsis for your state. If during that period of time you don't like what the insurance company says to you, you can then retain and attorney and he can file suit to toll the statute. Your only requirement is that he must file suit within the period of the statute for your state. If you retain an attorney he is going to get atleast 1/3 of the money he collects for you and I just don't see doing that unless there is a "need" to do it.

Keep copies of all expenses and receipt. Get a letter from your employer verifying the amount of wages you lost because of the accident. Get estimate or receipts for articles of clothing, etc that was ruined in the accident. Make copies of everything and submit them to the other insurance carrier and let them know that you are willing to hold off getting an attorney till they have had a chance to evaluate everything and make you an offer. If they ask you to sign a medical authorization, do it. It will enable them to go to the hospital/doctor to verify the injuries involved.Once you have their offer you then will be in a better position to decide whether getting an attorney would be to your benefit or not. Keep in mind your attorney would have to get 33 1/3% more than what they are offering you just to break even. That is because he is going to take atleast 33 1/3% for representing you.

I hope this makes sense to you and you can see the logic. Believe me when I tell you I have more than once seen an attorney get less than his client would if he were not represented. The insurance companies know very well which attorneys are willing and which aren't willing to go to trial.

Yep, you n the bike are both going to be in the shop for awhile.....I'm not being unsympathetic, just real.

Lunch time was it?......That has to be the absolute worst time...........Morning and evening rush are bad enuff, but for some reason lunch time drivers are worse....Maybe it's cause they are low on sugar-on limited lunch break-or it's also the time o day all the blind old ladies are out shopping.

I owe my survival to the fact I work rotating shifts.....Most nights and eveningsI ride my bikes to work, but days I'm in my big truck because all the commuting cageres are yacking on their cellswhile munching fries and screaming at their backseat brats.....I swear I can go out on weekend nights andride home drunk with less chance of injury than trying to navigate regular day time traffic.

Old timer's tip for you younger guys: When entering an intersection or stopped at an intersection always place yourself directly in front of drivers behind your.....Stay in the left side of your lane even if you intend to turn right.

Charliebox. Another good practice is to stay in gear at traffic signals, for that very reason.To get the hell out of Dodge if someone is comming up behind you fast. People who engage neutral and stretch their arms while the lights are red have no chance.[&:]

AWWWW reminds me of my nighty when some young women hit me. I think yours is a little worse though. I wish all I got was a broken arm. I broke, I mean she broke my left leg and right wrist. Trust me, you will be back on your bike in a few months. Atleast it happened during the winter season and not the summer. Took HD about 4 months to fix my nighty but thats durring peak riding season too. I'm sure if yours is not totaled it will be fixed in less time.
