Answer to some questions. Yes to helmet. No she was not talking on her cell phone. Yes had the driving lights on....Just plain bad timing.
A buddy of mine rides a BMW 1200LT with lights all over it. We call it the "Starship Enterprise" He told me he is going to put some more lights on mine when I get either a new on or mine back as a welcome back gift.

Rambo, glad to hear you are okay! I was a cop for 22 years and it never ceases to amaze me that people have trouble seeing a motorcycle but can spot a light bar or door shield on a police car a mile away! I read your other post about the bike being totaled, at least you'll get a new bike out of the deal. I crashed my Ultra 3 weeks after I got it with 1200 miles on it. All cosmetic damage on mine and I'm back on it now. I broke 8 ribs in the front, 2 or 3 in the back, my shoulderblade and collapsed a lung, all on the right side. Six weeks later I took my old 77 Electraglide out for a ride (the Ultra was still in the shop). You'll heal quick, but your first ride will be a little shakey and you will be paranoid as hell. It won't take long to get back to being comfortable on the bike, but you will probably always be a little more cautious than you were before. Heal quick and get back in the wind!

The most important thing is your health. Regardless of insurance carriers I would STRONGLY advise using an attorney to handle your claims. I know a lot of people are lawsuit happy over ridiculous incidents but you have a VALID reason.The medical expenses alone are staggering. Take care and I wish you a full recovery. TJ

In Alabama it would be. You can't buy a beer in Alabama without signing your rights to an attorney away in an arbitration agreement. I have State Farm, and it clearly states that if both parties have the same company, then the case will be settled by an arbitration board. It sucks, but what can you do?
What he said. Friend had State Farm here in Georgia and had an accident in car. Lady had State Farm and it was a pain to get them to pay for his car.
