You have too much going on to try and pinpoint what the problem is. My 2 cents. Hope all goes well, keep us posted.
I agree - the issues here seem a lot deeper than just a tune.

Well, OP, I feel ya, but this clown would have totally lost my confidence. ..as well as that shitty engine. If he has any professional scruples at all, hell refund your money and either put your engine back in, or better yet, just return your engine and leave it out of the frame. I agree that it doesn't appear to be a tuning problem. ..I think he pieced an engine together from odd parts, and they aren't working right together. Use the refund to either rebuild your powerplant, use the HD replacement program, or buy a good used, proven engine or aftermarket engine.

Wash your hands of this incompetent fool. And do it sooner than later.

My take on the problem is he didn't get the timing right on the cams. It would explain why it runs in the rpm range that it does.
One tooth off and it could run without causing interference with valves hitting pistons.
I'm sure someone with more experience could give you better information.

Just wanted to thank everyone for their input. I was back andforth on the phone with the original builder for a couple weeks and unfortunatelyhad a loss in the family that has tied me up for a few weeks. Original builderis falling behind on his Dyno install and since neither one of us wanted thisto go any longer I took it to a local (very reputable) tuner to me. Originalbuilder covered the cost of the e tune...long story short bikes runs and runsout real strong now. It was just the tune. It took over 50 miles on the tunerto get it right but he got it and it runs real good. If it wasn't for theoriginal builder talking to me so much and seeming on the up and up which Istill believe he is I would have went a different route and had him pull thatmotor and give me money back. Glad I followed my gut and rode this out. It isnot a supper build or super bike but definitely way more than the original 96and I can tell a lot more than a stock 103 for sure. Only got about 200 mileson it since its tune but mileage looks to be dang close to 40 which I reallylike also. Lots of power and sounds great. Again thank everyone for their input.

So your motor had 22K miles on it and the oil pump went out. Ok, who diagnosed that originally? What would that have cost just to repair or replace the oil pump and get the bike running? Why would you go into tearing the motor apart with only 22K miles on it? It was just getting "broken in". Sounds like you were taken to the cleaners. He's probably unloading your old 96 motor on somebody else.

Read the second paragraph of the OP's original post!

Sounds like the crank probably took out the oil pump and I assumed trashed the motor? I have seen that before, but usually with a lot more miles on the clock.

Very happy this worked out for ya, OP...but my original opinion of losing confidence in this builder stands. Shouldn't have ever left his shop like it did.

Original motor...crank was out .014. I checked that out. When motor started making noise I decided that damage was done. There were pieces of metal in oil pan when he dropped it to clean it. I believed I could not rebuild original motor for cost that I got the rebuilt 103 I bought. I wanted a welded or pinned crank and I wanted a Timken bearing so that is the way I went...if I had it to do over again I think I would have taken it to flora and let him tear into it and see what he could do but was trying to save as much money as I could since I iltteraly had just purchased the bike. All that is hindsight now and just needed to get my bike running or start over and luckily it worked out for me.
