The '09 has the new frame. That's a nice plus. Also a 6 speed trans, TBW, Delphi injection, 96ci. Parts can be easier to find. Given a choice the '09 would be mine. Don't get all hung up on the problems thing though. All years had one thing or another go wrong. And most have been fixed on a well kept bike. You didn't mention prices, conditions, etc. that matter as well. But as what you asked for that's my answer.
I bought my 2010 Electra Glide Limited in Dec. of 09 and It still has the original compensator in it, matter of fact I haven't even opened up the primary. But, I'm the original owner and also I change my engine and primary oils every 3k miles. Also I noted when changing the primary a dealer mechanic I questioned said he puts one quart of oil in, I put 38oz's in. I think a lot of these compensator problems are cause by, not keeping clean oil in there, a low oil level by not put the proper amount in, and not knowing how to shift smoothly.
It's a no brainer, buy the 09 mainly because of the 6 speed transmission, 6 gallon tank, and the newer frame, and hopefully the RKC also has cruise control, and ABS brakes.

I have an 09 RKC, only problem I've had with it was the rear brake relay switch, if I'm saying it right, that was a PITA to change. Other than that the bike has been great to me.
