If you have a Power Vision and I would assume similar tuner you can see if the automatic compression release is active using the tuner.
If no tuner, with ignition on and handlebar run switch off, flip handlebar switch to run position and you should hear a significant metallic click in the engine. That click is the ACR engaging. If you hear no click then the ACR is either turned off or not working.
I can hear a click down in the engine so I'd say they are working. It's a brand new battery so I'm skeptical of that being the problem but anything is possible
I have a 2022 Roadglide Limited that is doing the same thing. Battery tested fine at the dealership, not sure what the issue is. Going to have them replace spark plugs at my 5k in a month or so just in case.
In my case I always start in neutral so it's certainly not an only when starting in gear thing.
Mine does seem to be more prevalent if I have recently shut the bike down and then try to start again a short time later (gas stop, picking up the kid at school, etc). And it's not every time, maybe 1 out of ever 25 times.
Will be interesting to see if anybody has a confirmed solve.
I went home yesterday put my bike in neutral pulled in the clutch it started fine. Tried it several more times and it was OK. Left the lights on for a bit and tried still started ok. Started flawlessly today. It's weird . My bike has 10k on it and it never really gave me a problem with this till this spring.

Mine tested fine at the dealer too, but after it sat for a day slow crank. I bought a yuasa gyz series because they could not warranty it without a failed test. No problem since. Hot restart sounds like compression releases are not working or turned off. I have had a 17,19 and 20 ultra limited's and the batteries all got noticeably weaker the second year. Lots of basic electrical checks to do but no common issue other than junk harley batteries, Mike
@hazer I would strongly suggest you load check the battery. I know you said it is only a one-year old battery but, they do fail. The extra amperage required to start with the bike in gear may be just enough to give you this issue.
Step#1- load test battery. If it passes, go to step 2.
Step#2- perform a voltage drop test for the starter circuit to isolate the problem. If you have no idea what a voltage drop test is, go to youtube and type in "voltage drop test starter".
