Have the dealer verify the SE air filter assembly is installed properly. The installation instructions on the early versions for the 08's were printed wrong. Mine was installed wrong at the dealer and corrected later by an indy.
But more than likely, it's was just over filled. Happens especially when the bike is run at high speed long runs on hot days. As mentioned before, the full mark is when the oil is hot. If you fill it to the top of the mark with fresh oil, it will wexpand to over full when it gets hot.
My own personal procedure is to fill it with 3.5 quarts and leave it. Check it when I get home from my next ride and add if necessary.
I do my own maintenance. The dealer did an oil change for me once (long story) ....... I checked the level (cold) before accepting the bike. Yep ............. they'd filled it (cold) to the full level. I called him on it .......... end result was my giving oil-change 101 lessons to his junior wrench! My advice(?), do this work yourself. I always drain the bike hot, and then fill to the cold level and then top up as necessary. Old school, my daddy taught me, eh?
close to 8 grand on the clock and no oil in air filter problems here. I do my own services, by the book, put in 3.5 qts with new oil filter, start & run bike, then recheck. It's 1/2 quart low, then I add the remaining 1/2 quart.

It can be your oil pump isn't alighned properly. There is an article out on the internet that address's this issue. A buddy had his cam tensioner shoes replaced and lost a court of oil in 50 miles after leaving the shop. Indy came and took the bike back to the shop and re-alighned the oil pump and the guy has 12k miles with no oil leak.
OK, OK, ...I know i'll be eating some crow for a long time to come, for not reading my owners manual about the proper way to check your motor oil. (threading the cap in to check proper oil level)
Being that I am a 35 year auto tech, I guess I just skipped those pages on checking the oil.
The funny thing is... the tranny plug is checked on it's threads, not screwed in.
Also, on the dip stick, it say's DO NOT OVERFILL. I guess that aplies to everyone, even me.
I observed the same problem on my 06 Road King at around the 16,000 mile mark. I found that my K&N filter was dirty and need of recharging. After recharging the air filter no more oil blow back. Dirty air filter may reduce the air flow that sucks the excess oil back into the engine.
