From what I can tell they are talking about the compliance statement engraved on the muffler it self which on my ultra is located at about one o'clock on the right side muffler and obscured from view by the saddle bag.
I don't know what the answer is but I've got to think that motorcyclists and motorcycle parts manufacturers need a strong lobbyist. Harley isn't helping in this regard. The lobbyists we have so far don't seem to have the power needed to "have our backs".
Look around, do you see any segment of the government doing anything to support or protect the motorcyclist?

Sounds to me they're worried about "straight pipes" which are pipes that have no baffle. or pipes that have a baffle but are designed for racing.
The question is, are the aftermarket "stage 1" pipes that most of us have considered EPA approved. I'm sure the stock harley pipes are ok. Actually, I'm not sure, just assume they're ok.
I wouldn't mind riding the east coast sometime, and NYC would be a natural stop. This is quite a blow actually, buy a new bike from a harley dealer, then have it taken away as if you're an outlaw.

stock pipes have the EPA stamping. I have never seen a set of aftermarket pipes that have the stamp, so most (if not all) are illegal for street use as of 1987 or so. It's just never been enforced. The way NYC worded this ordinance, the bike doesn't even have to be running. if a metermaid checks the pipes and they are missing the EPA stamping, then its a fine and/or impoundment of the bike.
It's my understanding that this ordinance has been tabled for now, but could get resurrected very easily if they decide they want to tackle it.
We don't have a legal leg to stand on as I see it, but I keep wondering about the custom builders (like Indian Larry Legacy in NYC and others) that use custom pipes on their bikes. Hell, even the EPA will allow an individual one non-compliant bike per lifetime... what about THOSE bikes? If a bike is federal EPA exempt, how does NYC get away with this kind of measure?
